Maui Terms & Conditions

Valid 01 April 2007 to 31 March 2008

TERMS AND CONDITIONS

This document contains a summary of some of the Rental Conditions. For full detailed Conditions refer to the Conditions schedule in the Rental Agreement. Please note all prices quoted in this document are in New Zealand dollars. Rates and Conditions quoted in our brochures and/or documentation are subject to change without notice.

RENTAL DURATION

When calculating the number of days a vehicle is rented, the day of pick-up is counted as day one of the rental, regardless of pick-up time. The day of the vehicle's return is counted as the final day of the rental. When a rental moves from one rate season into the next, the calculation is based on both rates.

  • Minimum rental period for rentals is 5 days.
  • Minimum rental period for one-way rentals is 7 days (or as otherwise specified).
  • Minimum rental period of 10 days for hires between 23 December 2007 and 10 January 2008.
  • Late pick-up or early return of vehicle does not entitle the hirer to any refund of the unused portion of the rental.
  • Late returns will be charged on a per day basis.

ONE-WAY RENTALS

One-way rentals are available between all branch locations.

  • Rentals between Auckland and Wellington (and vice versa): 5-day minimum
  • Rentals between Christchurch and Queenstown (and vice versa): 5-day minimum
  • Rentals between North and South Islands (and vice versa): 7-day minimum with a one-way rental fee of NZ$150, where pick up is between 01 October 2007 and 31 March 2008.

DIESEL TAX RECOVERY FEE

The Diesel Tax Recovery fee will be calculated and collected on return of your vehicle based on the kilometres travelled during your hire.

The vehicle rates per 100km are as follows:

2 Berth: Nil
2 Berth (Toilet & Shower): NZ$3.30
4 Berth: NZ$3.50
6 Berth: NZ$3.70

Rates are subject to Government changes.

Note: Diesel Tax Recovery fee is included in the Premium Package.

BRANCH HOURS

Auckland, Christchurch, Queenstown and Wellington.

  • Auckland, Christchurch and Wellington: Daily from 0800 to 1730hrs (closed Christmas Day).
  • Queenstown: Daily from 0800 to 1730hrs in the summer months and daily from 0800 to 1700hrs in the winter months (closed Christmas Day).
  • Maui requests that clients collecting or returning their vehicle to be in the branch by 1700.
Vehicle collection and returns in Wellington incur a NZ$100.00 location fee and in Queenstown incur a NZ$175.00 location fee (same city collection and return, one fee applies). This is in addition to the one-way fee if applicable.

TRANSFER

Maui provides free airport to branch and branch to airport transfer on day of arrival and departure for our Auckland and Christchurch branch. Queenstown branch is located at the airport. The Wellington agency is located 40 minutes from the airport and clients must find their own transportation to and from the branch at their own expense.

Auckland

The Tourism Holdings Rentals Coach operates on a 30 minuted scheduled service between the International and Domestic terminals and Maui Auckland Branch from 0700 to 1730, 7 days:

Departing Auckland Airport - First bus 0700am, Last bus 1730pm
Departing Auckland Branch - First bus 0715am, Last bus 1755pm

At the Domestic and International terminals, the coach stops are located outside the main exit doors (look for the coach/shuttle stops). There is also a Maui Help Desk located inside the International Terminal if you need further assistance.

Christchurch

On arrival at Christchurch Domestic Airport, clients should proceed to the free phone information boards situated in the Baggage Claim area and dial the phone number specified on the Maui board.

On arrival at Christchurch International Airport, clients should proceed to the Tourism Holdings Rentals counter, or if that is unmanned, to the International Airport Information Centre. A Courtesy Bus will be dispatched to collect clients from the Main Airport Arrivals Entrance. 10 minutes should be allowed for the shuttle to arrive.

INFRINGEMENTS

We reserve the right to charge the hirer for any speeding or parking fines, associated administration costs and/or accidents including third party property damage not reported on return of the vehicle. The administration fee per fine will be NZ$60.

EXCHANGE RATE / CURRENCY VARIATIONS

All credit card transactions are conducted in New Zealand dollars. Due to exchange rate fluctuations there could be some variance in the amount refunded compared to the amount initially charged. Maui does not accept any liability for variances up or down.

CREDIT CARDS

If a credit card is presented as payment, the credit card holder will be jointly and severally liable as a customer. Accepted credit cards are Visa, MasterCard and American Express. A Merchant Fee Recovery charge of 1.5% applies to all credit card transactions.

Please note: the Fee will apply to the processing of any $5000 Bonds. Provided the vehicle is returned in proper order (as per the Rental Agreement), the Fee and Bond will be refunded to the client. The Fee is only retained when the Bond is retained.

DRIVER'S LICENCE

  • A current and full state or national driver's licence is required per driver at pick-up.
  • Provisional licences are not accepted.
  • Copies of driver's licences are not accepted.
  • If the licence is not readable in English or does not have a photo, an international driving permit must accompany the original licence. The permit must be issued in the same country as the driver's licence was issued. (An accredited English translation will be accepted in lieu of an international driving permit).

AGE RESTRICTIONS

Drivers must be 21 years of age or over. A medical certificate stating that the customer is fit to drive the vehicle they have booked for the duration of the hire is required for drivers over the age of 75.

KITCHEN AND PERSONAL KIT

One kitchen kit (crockery, cutlery, cooking utensils and tea towel) and personal kits for the number of clients travelling ( towel, pillow, pillowcase, duvet and bed sheet ) for all motorhomes is included in the daily rental rate at no extra cost.

BOOKING AMENDMENTS
  • Prior to pick-up, Salamanda Travel can assist with booking amendments up until the date of pick-up. This is subject to vehicle availability and may result in rate adjustments.
  • After pick-up, if the hirer wishes to extend the rental whilst on hire, they must contact Maui direct and obtain authorisation from the destination branch. This is subject to availability and any extra rental days are charged at Maui's standard (brochure) rates. The extra cost of an extended rental must be paid by credit card over the telephone on confirmation of the rental extension.

Failure to obtain authorisation will result in a daily fee of NZ$150 in addition to the daily rate.

CHANGE OF DROP-OFF DESTINATION

If the hirer wishes to change the drop-off destination after the rental has commenced, they must first obtain authorisation from the Reservations Centre in Auckland. Subject to the change being approved, an additional charge of up to NZ$500 may apply.

ROAD RESTRICTIONS

Motorhomes can only be driven on sealed/bitumen or well-maintained roads. No vehicle shall be driven on Skippers Road (Queenstown), Ninety Mile Beach (Northland), Ball Hut Road (Mt. Cook) and North of Colville Township (Coromandel Peninsula).

Maui reserves the right at its sole discretion to restrict vehicle movements in certain areas due to adverse road or weather conditions.

ON-ROAD ASSISTANCE

Any problems associated with the vehicle, including equipment failure, must be reported to Maui as soon as possible, and within 24 hours in order to give Maui the opportunity to rectify the problem during the rental. Failure to do so will compromise any claims for compensation. We do not accept liability for any claims submitted after this period.

REPAIRS

Repairs up to NZ$100 may be affected without authorisation and will be reimbursed. For amounts over NZ$100, Maui will need to be informed in advance. Repairs will be approved provided the hirer was not directly responsible for the damage. Receipts must be submitted for any repair or the claim will not be paid.

CHANGE OF VEHICLE

Should the vehicle booked be unavailable through unforeseen circumstances, Maui reserves the right to substitute an alternative vehicle without prior notification and at no extra cost. This shall not constitute a breach of contract and does not entitle the hirer to a refund.

VEHICLE CATEGORY

Vehicles cannot be requested by make or model, only by vehicle category.

VOLUNTARY DOWNGRADE

Should the hirer decide to take a smaller vehicle than booked they will not be entitled to any refund.

IMPORTANT

Maui reserves the right to refuse any rental at its discretion.

ANIMALS

No animals are permitted in our vehicles, excluding guide dogs.

BIKES AND SURFBOARDS

Bikes and surfboards are not permitted in (or on) any of the Maui vehicles. The Maui vehicles do not come with roof racks, bike racks or tow bars.

Maui clients receive a 10% discount at Top 10 parks (vouchers issued at pick-up).

PERSONAL AND COMPANY CHEQUES

Personal and Company cheques will not be accepted as payment for rentals at the time of pick-up. These must be received by Maui 14 days prior to commencement of rentals. Personal or Company cheques are not acceptable as the vehicle security deposit.

DISCLAIMER

Illustrations and text in any of our brochures or website are a representation only of the vehicle depicted. Variances in the vehicles offered for rental may occur due to substitutions made by Maui or modifications and/or upgrades to the vehicle design made by the manufacturer.

FOR YOUR PROTECTION

New Zealand legislation provides limited coverage for personal injury. We strongly recommend that all people travelling in New Zealand take out Personal Travel Insurance.

All vehicles are insured for the damage to the vehicle or to the property of a Third Party. The hirer is responsible for the first NZ$5,000 ("the excess") of the cost of damage to Third Party property or to the rented vehicle, including single vehicle accident, windscreen and tyre damage, towing and recovery costs, theft, fire, break-in or vandalism. This also includes the cost of the daily rental for the period the vehicle is off fleet for accident repairs (demurrage). The excess applies in respect of each claim, not rental.

The excess is applicable regardless of who is at fault and must be paid at the time the accident report is completed, not at the completion of the rental. The excess will be refunded if Maui are successful in recovering the cost of the damages from the Third Party. Please note that Third Party Claims can take months to resolve.

Please see the 'Exclusions' section below, whereby all Excess Reduction cover will be made void.

This NZ$5,000 excess can be reduced, in most circumstances, by the purchase of Excess Reduction Option 1 or Excess Reduction Option 2.

1) Excess Reduction Option 1

Cost per day: NZ$20.00 (max charge NZ$1000)
Excess reduced to NZ$2500

With Excess Reduction Option 1 the hirer is responsible for the first NZ$2,500 of ANY ACCIDENT COST (save for the exclusions below), of the cost of damage to Third Party property or to the rented vehicle, including single vehicle accident, windscreen and tyre damage, towing and recovery costs, theft, fire, break in or vandalism. This also includes the cost of the daily rental rate for the period the vehicle is off fleet for accident repairs (demurrage). The excess applies in respect of each claim, not rental.

Please see the 'Exclusions' section below, whereby all Excess Reduction cover will be made void.

2) Excess Reduction Option 2

Cost per day: NZ$38.00 (max charge NZ$1900)
Excess reduced to NZ$0

With Excess Reduction 2 the hirer will not have to pay any excess at all for any damage to the vehicle or property of a third party (apart from the exclusions listed below).

Note: Excess Reduction Option 2 is included in the Premium Package.

Please see the 'Exclusions' section below, whereby all Excess Reduction cover will be made void.

The no worries cover option is a one off fee of NZ$50 per hire. The no worries cover option is only available when excess reduction 2 has been purchased.

Note: the no worries cover option is included in the Maui Premium Package.

With the no worries cover option, the hirer will not have to pay any excess at all for any damage to the vehicle or property of a third party with the exception of the 'exclusions'. This will include accidental overhead or underbody damage to the vehicle. Please note overhead and underbody damage cover is excluded unless the no worries cover option has been purchased.

TYRE AND WINDSCREEN DAMAGE - Where the hire has a nil excess up to one windscreen and two tyres will be covered for accidental damage. Should these amounts be exceeded the cost to repair or replace the items will not be covered and will be the responsibility of the hirer.

MAUI STRONGLY RECOMMENDS OUR CUSTOMERS TAKE NO WORRIES COVER FOR TRAVEL WITH COMPLETE PEACE OF MIND.

EXCLUSIONS:

Standard Excess, Excess Reduction Option 1 & 2 do not cover:

1. Overhead and underbody damage to the vehicle - except where no worries cover has been purchased.

2. Any water related damage which includes, but is not limited to:

a) any vehicle submersion
b) creek or river crossing
c) driving through low plain flooded areas
d) beach driving

3. Personal belongings. Maui recommend the hirer does not leave valuables in the vehicle and that they have insurance to cover for the loss/damage of personal belongings.

4. Any damage caused by willful misconduct (e.g. sitting or standing on the bonnet or roof of the vehicle).

5. Any damage caused while driving under the influence of alcohol or drugs.

6. The incorrect use of fuel (fuel being diesel or petrol) or contaminated fuel. The hirer will be responsible for any associated cost.

7. The cost to retrieve or recover a vehicle, which may include, but is not limited to a vehicle that has become bogged, submerged or has been abandoned.

8. The cost to replace keys, which have been lost or retrieval of keys, which have been locked in a vehicle.

9. The vehicle rented may only be used to carry the maximum number of passengers as dictated by the vehicle type. If more passengers are carried than what is allowed Maui does not accept any liability.

10. Drivers not identified on the rental agreement and/or drivers that have a licence that has been cancelled or suspended and/or drivers who have a licence that is classified as a learners or probationary licence.

VEHICLE SECURITY DEPOSIT

Upon vehicle collection, a security deposit is required. The amount is determined by the excess reduction option selected.

For security purposes, only a credit card can be used to provide a vehicle security deposit. The credit card holder must be present and able to sign for the vehicle security deposit upon vehicle collection. The credit card holder is jointly and severally liable for any damage to the rental vehicle.

( In the USA a vehicle security deposit is referred to as the "deductible").

All debited bonds are subject to a 1.5% credit card surcharge in addition to the bond amount. This surcharge is refunded when the bond is refunded. If a bond is retained the surcharge is retained.

- If you do not take an excess reduction option, the security deposit is NZ$5,000 payable by credit card.

The NZ$5000 is debited to the hirer's credit card when the vehicle is collected. For this reason it is important that the hirer have the funds available on the credit card and that the amount does not exceed the hirer's daily withdrawal allowance.

- If excess reduction option 1 has been taken the Security Deposit is NZ$2,500.

The NZ$2500 is debited to the hirer's credit card when the vehicle is collected. For this reason it is important that the hirer have the funds available on the credit card and that the amount does not exceed the hirer's daily withdrawal allowance.

- If Excess Reduction Option 2 is nominated with or without no worries cover or the package booked is the premium package the security deposit is NZ$220.

The NZ$220 is taken as an imprint to the hirer's credit card when the vehicle is collected. An imprint simply records a figure against the hirer's credit card of NZ$220 that Maui can then debit if required.

The security deposit is fully refundable provided the vehicle is returned on time, to the correct location, undamaged, with a clean interior and with full fuel tanks (fuel being petrol or diesel) and gas bottle. Except where the customer has purchased PGO (PGO is included in the Maui premium package) and/or Pre Purchase Fuel (PPF), failure to return the vehicle with full petrol or diesel tanks and/or a full LPG bottle will result in refill charges, which will be advised upon return of the vehicle.

Maui reserves the right to retain a NZ $125 cleaning fee if the vehicle is not returned with the interior in a clean condition. The toilet and waste water tank must be emptied prior to the return of the vehicle, or an additional NZ$125 soiling fee will be retained.

Cheques are not an acceptable method in which to supply a vehicle security deposit and will not be accepted.

In the instance where your customer does not hold a credit card for the purpose of the vehicle security deposit or the credit card holder will not be present upon vehicle collection Maui does provide the option to leave the security deposit via cash or travellers cheques or can arrange for a credit card to be debited prior to the rental commencing. It must be advised to Maui at least 14 working days in advance of vehicle collection that a cash or travellers cheque vehicle security bond or a prior credit card debit is required. This cannot be arranged upon vehicle collection. Please note strict guidelines and criteria must be met for cash /travellers cheques vehicle security deposits and prior credit card debits. Please contact reservations for more information if required.

FOR SECURITY PURPOSES MAUI STRONGLY RECOMMENDS THE USE OF CREDIT CARDS FOR VEHICLE SECURITY DEPOSITS.
